Terms of Service

Last updated: 13 October 2026

These Terms of Service ("Terms") govern your use of niuty.com, the niuty platform, your niuty instances, and the live-lib software (together, the "Service"), provided by the operator of niuty.com ("niuty", "we", "us"). "You" or "Customer" means the person or organization that signs up for, pays for, or uses the Service, including through an AWS account used to sign in.

By signing up, provisioning an instance, installing live-lib, or otherwise using the Service, you agree to these Terms. If you use the Service on behalf of an organization, you confirm you are authorized to bind that organization. If you do not agree, do not use the Service.

1. What the Service is

niuty provides developer infrastructure only:

  • a dedicated LiveKit media relay instance ("Instance") that forwards audio, video and data between the participants of your sessions; and
  • live-lib, a software library you install and run on your own systems.

niuty does not provide, operate or control your application, your agents, your AI or model providers, or your end users' devices. You build and operate your own application on top of the Service. niuty is not a party to any relationship between you and your end users.

2. Your responsibilities

You are solely responsible for:

  1. Your application and your end users — its design, behavior, content and outputs (including anything generated by AI models you choose to use), its safety and suitability for its intended users, and all communications with and obligations to your end users.
  2. Legal compliance — complying with all laws and regulations that apply to your application and to the personal data you or your application collects, uses or transmits, in every jurisdiction where your end users are located, including privacy, data protection, consumer protection, recording-consent and children's-privacy laws.
  3. Notices and consents — providing all required notices and obtaining all required consents (including any consent to record or process voice, video or images, and any parental consent) before any data is sent through the Service.
  4. Third-party services — your accounts with, and your compliance with the terms and usage policies of, any third-party services you use with the Service, such as OpenAI, Google, or other model, speech or cloud providers. niuty does not relay or control traffic between your systems and those providers, and their data controls apply as you configure them.
  5. Configuration — configuring and using the Service appropriately for your use case, including the privacy settings described in the Docs, and keeping live-lib up to date.
  6. Security — keeping your AWS account, credential files, API keys and tokens secure. You are responsible for all activity under your account and credentials.
  7. Your data — keeping your own copies of anything you need. niuty does not back up session data, and Instances are deleted when they are deprovisioned.

3. Children and sensitive data

The Service is general-purpose developer infrastructure and is not directed at children. niuty does not knowingly collect personal data directly from children.

If your application is used by, directed at, or likely to be used by children or other minors, or processes sensitive personal data (for example health, biometric or education data), you alone are responsible for determining whether that use is lawful and appropriate and for all related obligations, including verifiable parental consent, age-appropriate design, data minimization, and compliance with applicable laws (such as COPPA in the United States, the GDPR in the EU/UK, Thailand's PDPA, or equivalent laws elsewhere) and with the terms of every third-party provider you use. niuty does not review or approve any Customer's use case, and no communication from niuty is a statement that your use is lawful.

You must not place personal data — such as a person's name — in room names, participant identities, participant names, metadata or attributes. Use opaque identifiers.

4. Acceptable use

You must not use the Service, or allow it to be used, to:

  • break any law, or infringe anyone's rights, including privacy and intellectual-property rights;
  • create, store or transmit any content that sexually exploits or endangers minors, or otherwise harm minors in any way;
  • harass, threaten, deceive or defraud anyone, or impersonate any person;
  • record, monitor or analyze anyone's voice, image or communications without legally required notice and consent;
  • distribute malware, or attack, probe or overload the Service or any other system;
  • bypass or interfere with credit checks, usage limits, credential protections or other controls, or reverse engineer, decompile or deobfuscate live-lib, except where the law expressly allows it; or
  • resell or provide the Service to third parties as a standalone service without our written agreement.

We may investigate suspected violations and may suspend or terminate the Service immediately, without notice or refund, where we reasonably believe these Terms have been violated or the Service is being used in a way that could harm niuty, other customers or anyone else.

5. Data handling

How the Service handles session data is described in the Data handling and privacy section of the Docs. In summary, Instances relay media and messages without recording them, and keep connection logs only until the Instance is deleted. With respect to personal data your application sends through the Service, you are the party that decides why and how it is processed, and niuty processes it only to provide the Service to you. That description is provided for information; it is not a warranty and may change as the Service changes. How we handle personal information about you as our customer is described in our Privacy Policy.

6. Credits, payment and deprovisioning

The Service is prepaid with credits, as described on the Pricing page and in the Docs. Each instance billing cycle is charged in advance from your credit balance. If your balance cannot cover the next cycle, the Instance is deprovisioned and deleted, including its logs and configuration. Payments are processed by our payment provider, whose terms also apply to the transaction. Except where required by law, credits and payments are non-refundable and credits have no cash value.

7. Availability and changes

The Service is provided on an "as available" basis without any service-level commitment. Instances may be restarted for maintenance, including scheduled automatic restarts, and sessions may be interrupted. We may change, suspend or discontinue any part of the Service, including live-lib versions and features, at any time.

8. Disclaimer of warranties

To the maximum extent permitted by law, the Service is provided "AS IS" and "AS AVAILABLE", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, security, or that the Service will be uninterrupted or error-free. niuty makes no warranty about the output of any AI model or third-party service used with the Service.

9. Limitation of liability

To the maximum extent permitted by law: (a) niuty will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, data, goodwill or business, however caused; and (b) niuty's total liability for all claims relating to the Service or these Terms will not exceed the amount you paid niuty for the Service in the three (3) months before the event giving rise to the claim. These limits apply regardless of the legal theory, even if niuty was advised of the possibility of the damage.

10. Indemnity

You will defend, indemnify and hold harmless niuty and its operators from and against all claims, losses, liabilities, damages, fines, penalties, costs and expenses (including reasonable legal fees) arising out of or relating to: your application; your end users (including any children or other minors who use your application); data you or your application send through the Service; your use of third-party services; or your breach of these Terms or of any law.

11. Termination

You may stop using the Service at any time. We may suspend or terminate your access as described in section 4, or if you fail to pay. Sections 2, 3, 5 and 8–12 survive termination.

12. General

We may update these Terms by publishing a new version on this page; the "Last updated" date shows when. Continued use of the Service after an update means you accept it. These Terms, together with the policies they reference, are the entire agreement between you and niuty about the Service, and take precedence over any email, chat, support message or other communication, unless a separate written agreement signed by niuty expressly says otherwise. If any provision is unenforceable, the rest remains in effect. Failure to enforce a provision is not a waiver.
